As highlighted by Managing Editor Wayne Winegarden, more than 20 state and local governments are filing frivolous lawsuits against opioid manufacturers accusing them of fraud and deceptive marketing practices. The lawsuits are tenuous, as indicated by the California Supreme Court’s skeptical responses to the plaintiff’s claims. Worse, shaking down private industries to pad government coffers, and enriching private lawyers in the process, will not alleviate the opioid abuse crisis nor help pain patients receive their medicines. It will expand the problem of frivolous lawsuits that unnecessarily cost the U.S. health care system billions of dollars a year.
